Alderman Cain & Neill represents individuals and corporations in discrimination matters which include race, sex, gender, and age discrimination, sexual harassment, family leave, pregnancy discrimination, and payroll discrimination. The diversity of our representation allows us and our clients to address issues at the investigatory stage through the EEOC or the Texas Commission on Human Rights stage, before a potential lawsuit is filed and to handle resulting lawsuits under Title VII and other federal and state statutes.

• Before the Lawsuit – Many of our clients contact us before an employment step is made to avoid subsequent litigation. Our clients also hire us to investigate at an early stage whether a problem exists or the merits of claims before the lawsuit. The firm has an excellent record of resolution of such matters before they reach the lawsuit stage, including preventing potential suits for gender discrimination and sexual harassment. The earlier we are consulted, the more likely our clients are to receive an early and favorable resolution of discrimination or harassment issues.

• The EEOC and Texas Commission on Human Rights – On many occasions the firm has represented clients through the governmental process before the lawsuit, including preparing the EEOC response, conciliation, mediation, and Section 321 claims. We have had great success proceeding through the process quickly but also handle numerous cases which become protracted before the EEOC and with the Justice Department.

• The Discrimination Lawsuit – The firm is well situated within the federal Eastern District of Texas and geographically in Deep East Texas to handle discrimination claims in either state or federal Court. We have been adept in obtaining early dismissals on both time barred issues in discrimination and statutory construction issues. If the case proceeds to trial, our experienced team of litigators successfully represent many clients. In the event an appeal is necessary, firm member Robert Cain is board certified in civil appellate law by the Texas Board of Legal Specialization and is admitted in all Texas appellate courts and federal courts, including the Fifth Circuit and the Supreme Court of the United States.
